Privacy Policy

The web servers of the Bavarian Academy of Sciences and Humanities (BAdW) and the Leibniz Supercomputing Centre (LRZ) are operated by the LRZ, Boltzmannstraße 1, 85748 Garching near Munich. The personal data processed in this context is subject to the applicable data protection regulations, in particular the Bavarian Data Protection Act (BayDSG) and the Telemedia Act (TMG).

In accordance with the EU General Data Protection Regulation, the Bavarian Academy of Sciences, Alfons-Goppel-Str. 11, 80539 Munich (Legal Notice), is responsible for the processing of the data.

Below, we provide information on the nature, scope and purpose of the collection and use of personal data. The current version of this information can be accessed at any time on our website.

Accessing web pages

When a page or subpage on badw.de is accessed, the web server temporarily stores the following information:

  • IP address of the requesting computer
  • Date and time of access
  • Name, URL and amount of data transferred for the file accessed
  • Access status (file requested and transferred, not found, etc.)
  • Identification data of the browser and operating system used (if transmitted by the requesting web browser)
  • Website from which the access originated (if transmitted by the requesting web browser)

These entries are continuously analysed automatically in order to detect attacks on the web servers and respond accordingly. In individual cases, i.e. in the event of reported malfunctions, errors and security incidents, a manual analysis is carried out. The legal basis stems from the obligation to ensure the IT security of a website pursuant to Section 13(7) of the German Telemedia Act (TMG) and from the general obligation and state duty regarding IT security pursuant to Article 11(1) sentence 1 of the Bavarian Electronic Government Act (BayEGovG).

Entries older than seven days are anonymised by truncating the IP address. The anonymised data is used to compile access statistics. The software used for this purpose is operated locally by the LRZ.

The IP addresses contained in the entries are not combined with other data sets, meaning that it is not possible to identify individual persons.

Session identifiers (so-called ‘session cookies’) may be used on the websites of BAdW research projects and in applications of BAdW research projects accessible via the internet. These session identifiers serve solely to provide the functions offered on these pages and are not used to track user behaviour.

Analysis of key topics

It is in our legitimate interest, pursuant to Article 6(1)(f) of the GDPR, to identify the topics that are of particular interest to visitors to our website in order to improve the information we provide. To this end, we use Matomo as a tool on our servers. The same categories of data as in the section ‘Accessing web pages’ are collected, although the IP address is anonymised prior to analysis. We use Matomo in such a way that a visitor to our website can only be identified for a specific period of time, currently half an hour. Matomo carries out statistical analyses to determine which of our web pages this user accesses. Based on these analyses, we can, for example, identify which topics are accessed more frequently than others, or how our offers are received.

Matomo respects your browser settings, which allow you to generally prohibit any form of user tracking. No further profiling beyond that carried out by Matomo takes place. No data is transferred to third parties.

Newsletter

When you sign up for our newsletter, we use the data you provide solely for this purpose and to keep you informed about matters relevant to this service or the registration process. A valid email address is required to receive the newsletter. We also store the IP address you use to sign up for the newsletter, as well as the date and time you subscribe. To ensure that an email address is not added to our mailing list by third parties without authorisation, we use the so-called double opt-in procedure in accordance with the law. As part of this procedure, the subscription to the newsletter, the sending of the confirmation email and the receipt of the subscription confirmation are logged. This data serves as proof of your consent. Your consent forms the legal basis for this data collection in accordance with Article 6(1)(a) of the GDPR. No data is collected through the use of our newsletter that would enable user tracking or other statistical analyses.

The newsletter is sent using the newsletter service provided by BREVO (www.brevo.com). In doing so, your data is transferred to Brevo GmbH, a German limited liability company, with its registered office at Köpenicker Str. 126, 10179 Berlin, Germany. Our data processor, BREVO, is a certified provider that delivers its services in accordance with the requirements of the EU General Data Protection Regulation and the German Federal Data Protection Act. You may withdraw your consent to the storage of your data and its use for the purpose of sending the newsletter at any time. To do so, we provide a link in every newsletter and on our website. You may also notify us of your wish to withdraw your consent directly by emailing presse[at]badw.de.

Social media and external service providers

Where social media icons for Facebook, LinkedIn and others are used on our websites, no personal data is shared. To prevent automatic data transfer, we link to these providers via URL. For data protection reasons, we do not use any active social media plugins.

Our social media presence forms part of our public relations work. Our aim is to provide information tailored to our target audience.

By consenting to the use of our social media channels, you agree that information may be disclosed to the provider of this service and may be transferred to the USA. The data processed may include, in particular, users’ IP addresses and location data. The provider may use this information to analyse your behaviour and, where appropriate, use the results to display and market personalised advertising. There is currently no decision by the European Commission that the USA generally offers an adequate level of data protection. At the same time, in accordance with Article 49(1)(a) of the GDPR, you accept the risk that your data may be accessed by US authorities in secret or for surveillance purposes. There is no guaranteed right of appeal against this processing. Use of the feature is subject to the provider’s terms and conditions and guidelines. Where you use our social media channels, we do not collect any personal data or log data. However, the providers of these platforms do process your personal data. The use of services on social media platforms is voluntary and takes place in full knowledge of the relevant data protection provisions.

Registration and contact forms

Any personal data that you may send to us via contact forms, registration forms and similar means on our website will only be accepted with your consent and will be used exclusively for the purpose stated in the forms.

To this end, the department receiving your enquiry (e.g. the press office or the secretariat) may forward your email to the relevant contact persons within the Academy. Once your enquiry has been dealt with, the data submitted to us with your enquiry will be deleted from our computers, both in the press office and by all other contact persons.

If you send us enquiries relating to research, these, including our replies, may be incorporated into the research data of the relevant project and stored there permanently.

Disclosure of personal data

Personal data is only disclosed to government bodies and authorities where required by mandatory national legislation, or where such disclosure is necessary for legal or criminal proceedings in the event of attacks on our IT infrastructure. Personal data is not disclosed to third parties for any other purpose, nor is it made public.

Your rights

You have the right to access your personal data stored by us, to have incorrect data rectified, and to request erasure, restriction of processing and, where applicable, data portability.

If you wish to exercise these rights, please contact the Academy’s management or the Data Protection Officer in writing.
